Level 3: German Textile Labels - Mandatory Enforcement of Regulations 1007/2011
Austria implements EU Regulation (EU) No 1007/2011 domestically through the Textile Labeling Regulation (Textilkennzeichnungsverordnung). The label must clearly and legibly indicate the fiber composition on or inside the textile in German. The fiber composition must be labeled with a common name and percentage, and the label must be durable and firmly attached. Non compliant labels will trigger compliance review by the Austrian trade regulatory authorities.
Fourth level: Brand authorization - Austrian customs can proactively detain infringing goods
According to the EU Intellectual Property Border Enforcement Regulations, Austrian customs have the right to proactively detain goods suspected of trademark infringement. The rights holder may submit a written application to the Austrian Customs (with Villach Customs as the competent authority) requesting the Customs to take detention measures against the suspected infringing goods. The detention decision is valid for up to one year and can be extended upon expiration. The customs shall notify the declarant and the right holder within one working day after detention.
